Landlord and Tenant

Neil Farrell and his team’s knowledge of the key legal and commercial issues affecting our sector is second to none. We use the Anderson Strathern team for our work and I would wholeheartedly recommend them.
Louise Isaac, Asset Manager, Quintain Estates

We have a wealth of experience in acting for landlords, tenants and institutions as well as private property investors. We understand the need for commercial leases that are workable and marketable.

We have three partners who are accredited specialists in Commercial Leasing under the accreditation scheme run by The Law Society of Scotland. One of our partners, Ken Gerber, has recently written the textbook  'Commercial Leases in Scotland : A Practitioner's Guide'.

The law on Landlord and Tenant is significantly different in Scotland from that of other parts of the UK. The form of lease document commonly used for commercial property leasing in Scotland may appear familiar to those involved in leases elsewhere in the UK, but there are very different implied terms and laws that affect Scottish leases, and it is essential to obtain detailed legal advice.

Whether acting for the landlord or tenant, we will advise and negotiate to achieve the strongest position for you. We advise on drafting and interpretation of commercial lease documentation including, in particular, repairs, dilapidations, rent review, transfer of leases and sub-lease transactions.

For more information please contact Ken Gerber, Alan Menzies or David Hunter.
